Affiliate Program Terms & Conditions

1. Eligibility

The Production OS Affiliate Program is open to individuals 18 years or older, and to legal entities in good standing. You may not enroll if you are a current employee or contractor of Production Labs, LLC unless explicitly approved in writing.

2. Three Tiers

The Program has three tiers, governing commission rates and cookie windows:

• Open Affiliate — default tier on signup. 20% recurring commission for the lifetime of each referred customer. 60-day cookie attribution window. Auto-approved.
• Founding Member — auto-enrolled upon your first paid Production OS subscription. 25% recurring commission for the lifetime of each referred customer. 90-day cookie. Status is retained as long as you remain a paying Production OS customer in good standing.
• Champion — application-based tier for affiliates who refer 5+ Solo customers OR 1+ Team/Brokerage customer. 30% recurring commission for the lifetime of each referred customer. 90-day cookie. Production Labs, LLC retains sole discretion over Champion approvals and may revoke Champion status for cause.

3. Commission & Payouts

Commission is calculated as the applicable percentage of recurring subscription revenue actually collected from the referred customer (i.e., net of refunds, chargebacks, and any unpaid invoices). Commission does not apply to one-time onboarding fees (Done-For-You, Accelerator, or team provisioning) unless explicitly noted in your tier agreement.

• Payouts are processed monthly via the Program platform (Rewardful), with a Net-30 holdback period after the referred customer's payment to allow refund processing.
• Minimum payout threshold: USD $50. Balances below the threshold roll forward.
• Payouts via Wise (international) or PayPal (US), at your selection.
• You are solely responsible for any taxes owed on commissions. Production Labs, LLC will issue tax forms where required by law (e.g., 1099-NEC for US residents earning $600+ in a calendar year).

4. Attribution & Cookie Windows

Attribution is cookie-based and last-touch. If a prospect clicks multiple affiliate links before purchasing, the affiliate whose link was clicked most recently within the applicable cookie window receives full commission. Cookie windows are: 60 days for Open, 90 days for Founding Member and Champion.

5. Lifetime Commission

"Lifetime" means the entire duration of the referred customer's active, paid subscription with Production Labs, LLC. If the customer cancels and later resubscribes without intervening attribution to another affiliate, your commission continues on the resubscription. Production Labs, LLC reserves the right to change tier rates prospectively (i.e., for new referrals), but rates locked at the time of a referral apply for the life of that referral.

6. Prohibited Conduct

The following constitute material breach and may result in immediate termination of your account, forfeiture of unpaid commissions, and where applicable legal action:

• Bidding on Production Labs, LLC trademarks (including "Production OS," "Agent Growth OS," "Production Index," and "PI Score") in paid search or display advertising.
• Self-referrals (purchasing a subscription under your own account or that of an affiliated party to earn commission on yourself).
• Spam, including unsolicited email, SMS, social DMs, or scraped contact lists.
• False, misleading, or fraudulent claims regarding Production OS features, pricing, results, or affiliations.
• Cookie stuffing, traffic injection, click fraud, or any manipulation of tracking.
• Impersonation of Production Labs, LLC or its employees.
• Promotion in any context that violates applicable law, including the FTC Endorsement Guides — you must clearly disclose your affiliate relationship to anyone you promote to.

7. Refunds & Chargebacks

If a referred customer is refunded under the 30-day money-back guarantee or charges back any payment, the corresponding commission is reversed. If commission has already been paid out, the reversal is deducted from your next payout. Persistent chargeback patterns on your referrals may result in tier downgrade or program removal.

8. Term & Termination

You may terminate participation in the Program at any time by deactivating your account through the Rewardful dashboard. Production Labs, LLC may terminate your account for breach of these Terms or for any reason on 30 days' notice. Upon termination, unpaid commissions earned in compliance with these Terms before termination remain payable; commissions on referrals made after termination do not accrue.

9. Modification

Production Labs, LLC may modify these Terms prospectively. Changes will be posted on this page with an updated Effective Date and emailed to active affiliates at least 14 days before taking effect. Continued participation after the effective date constitutes acceptance.

10. Disclaimer & Limitation of Liability

The Program is provided "as is." Production Labs, LLC makes no warranty as to commissions earned, attribution accuracy, or referral conversion. To the maximum extent permitted by law, Production Labs, LLC's aggregate liability under these Terms is limited to commissions unpaid to you at the time of dispute.

11. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Wake County, North Carolina, and you consent to the jurisdiction of those courts.
